This Privacy Policy explains how Black Rock Properties Georgia LLC (“Black Rock”, “we”, “us”) collects, uses, shares and protects personal data when you visit our website, contact us, or use our property advisory services in Georgia.
We process personal data in accordance with the Law of Georgia on Personal Data Protection and, where they apply to you, the EU General Data Protection Regulation (GDPR) and the UK GDPR.
1. Who we are
The controller of your personal data is Black Rock Properties Georgia LLC, a limited liability company registered in Georgia under identification code 422774643. Our registered details can be checked in the Public Registry of Georgia.
- Email: invest.georgia.guide@gmail.com
- WhatsApp / phone: +995 555 364 174
- Website: blackrocksproperties.com
For any question about this policy or your personal data, write to the email address above with “Privacy” in the subject line.
2. The personal data we collect
Information you give us:
- Contact details: name, email address, phone or WhatsApp number, country of residence.
- Inquiry details: budget, preferred locations, layouts and timeline, and anything you write in your messages.
- Information submitted through Facebook or Instagram lead forms.
- If you proceed with a purchase: passport or ID details, nationality, address, and the information needed to prepare reservation and purchase documents, open a bank account, apply for a mortgage or register ownership.
- Payment-related information you choose to share with us, such as proof of transfer to a developer. We do not take card payments through the website.
Information collected automatically when you use the website:
- Technical data such as IP address, browser type, device and pages visited, processed by our hosting and security provider and by privacy-focused, cookie-free website analytics.
- Your currency choice (GEL, USD, EUR or GBP), stored on your own device in your browser’s local storage so the website remembers it. It is not sent to us.
We do not use advertising or tracking cookies on this website. We do not knowingly collect special categories of data (such as health or religious data) and ask you not to send them.
3. How the website contact form works
The form on our website does not send or store your details on our servers. When you press “Send on WhatsApp” or “Send by email”, your message is prepared in your own WhatsApp or email app, and nothing is sent until you send it there. From that point your message is handled under WhatsApp’s (Meta’s) or your email provider’s terms, and we receive it like any other message.
4. Why we use your data and our legal grounds
- To answer your inquiry and send property options, prices and payment plans: because you asked us to (steps taken at your request before a contract) and our legitimate interest in responding to prospective clients.
- To provide our advisory and support services, arrange viewings, introduce you to developers, lawyers, banks and notaries, and help with registration: to perform our agreement with you.
- To verify identity and keep records required by law, including tax, accounting and any anti-money-laundering obligations that apply to a transaction: to comply with legal obligations.
- To keep the website secure and understand, in aggregate, how it is used: our legitimate interest in running a safe, working website.
- To send you new property offers or newsletters: only with your consent, which you can withdraw at any time.
- To establish, exercise or defend legal claims: our legitimate interest and legal obligations.
Where we rely on legitimate interests, we have balanced them against your rights. You can object at any time (see section 10).
5. Who we share your data with
We do not sell your personal data. We share it only as far as needed for the purposes above, with:
- Property developers whose projects you are interested in, so they can confirm availability, reserve a unit or prepare contracts.
- Lawyers, notaries, translators and banks you choose to work with, or that are needed for the transaction.
- The National Agency of Public Registry, the Public Service Development Agency, the Revenue Service and other Georgian authorities, where required for registration, residence or tax matters, or where the law requires disclosure.
- Property management companies, if you ask us to arrange management or rental of your property.
- Service providers who process data for us: website hosting, security and analytics (Cloudflare), email (Google) and messaging (WhatsApp / Meta).
Our service providers may only use your data to provide their services to us and must protect it.
6. Facebook and Instagram lead forms
If you reply to one of our advertisements through a Facebook or Instagram form, Meta collects your details and passes them to us. Meta processes that data under its own privacy policy. We use the details only to respond to your inquiry as described in this policy.
7. International transfers
We are based in Georgia and work with clients and service providers in other countries. Your data may therefore be processed outside your home country, including in Georgia, the European Union, the United Kingdom, the United States and other countries where our providers operate.
When we transfer personal data out of Georgia, we do so only where the Law of Georgia on Personal Data Protection allows it, for example where the destination provides an adequate level of protection, where appropriate safeguards such as standard contractual clauses are in place, or where the transfer is necessary to provide the services you asked for. Contact us for details of the safeguards that apply to your data.
8. How long we keep your data
- Inquiries that do not lead to a purchase: up to 24 months after our last contact, then deleted or anonymized.
- Clients who buy through us: for the duration of our relationship and then for as long as required by Georgian tax, accounting and other laws, generally up to 6 years.
- Marketing contacts: until you withdraw consent or unsubscribe.
- Technical website logs: for the short periods set by our hosting provider.
We may keep data longer if we need it to establish or defend a legal claim.
9. Security
We use appropriate technical and organizational measures to protect personal data, including secure (HTTPS) connections, access limited to people who need it, and providers with recognized security standards. No system is completely secure; if a personal data breach is likely to affect your rights, we will notify you and the competent authority where the law requires it.
10. Your rights
Under the Law of Georgia on Personal Data Protection, and the GDPR or UK GDPR where they apply, you have the right to:
- be informed about how your data is processed and get a copy of it;
- have inaccurate or incomplete data corrected;
- have your data deleted or destroyed where there is no longer a lawful reason to keep it;
- have processing restricted (blocked) in certain cases;
- object to processing, including at any time to direct marketing;
- receive data you provided to us in a portable format, where applicable;
- withdraw consent at any time, without affecting processing that took place before; and
- not be subject to decisions based solely on automated processing. We do not make such decisions.
To use any of these rights, contact us at invest.georgia.guide@gmail.com. We may ask you to confirm your identity. We will reply within the time limits set by law, generally within ten working days, and tell you if we need more time.
11. Complaints
If you are unhappy with how we handle your data, please contact us first so we can try to resolve it. You also have the right to complain to the Personal Data Protection Service of Georgia (personaldata.ge). If you live in the European Union or the United Kingdom, you may also complain to your local data protection authority, such as the UK Information Commissioner’s Office.
12. Marketing
Replying to your inquiry is not marketing. We will only send you new offers, newsletters or similar messages if you have agreed to receive them, and every such message will tell you how to stop them. You can unsubscribe at any time by replying “stop” or writing to us.
13. Children
Our services are for adults. We do not knowingly collect personal data from anyone under 18. If you believe a child has sent us personal data, contact us and we will delete it.
14. Links to other websites
Our website links to developers’ websites, social networks, WhatsApp, maps and media articles. Those services have their own privacy policies, and we are not responsible for how they handle your data.
15. Changes to this policy
We may update this policy when our services, providers or the law change. The current version, with its date, is always on this page. If changes are significant, we will tell clients we are in contact with.
